Question for legal types and others with informed opinions:

What's the latest on the problems associated with taking photos of things that have a trademarked label on them, such as a photo of a car which says "Ford"? Does this amount to trademark infringement or dilution, or does it fit under the exception for "non commercial uses" and parody/commentary etc? The last time I checked into this area of the law was 9th Cir. Ct's judge Kozinski's opinion re Barbie.
